RESOLUTION PASSED BY FREELANCE INTERPRETERS ON 12 NOVEMBER 1998

The freelance interpreters, members and non-members of AIIC, who work for the European Union Sector, gathered at the sectoral meeting in Brussels on 12th November 1998 (213 present, 295 represented):

· having heard the report given by the Negotiating Delegation following the inter-institutional consultation of 12th November 1998;

· informed of the fact that the institutions have deemed admissible AIIC's response to the Call for expressions of interest published in the OJ of 14/08/98;

1. Welcome the progress achieved in the procedure to amend Art 78 of the CEOS to extend the regulation which applies to auxiliary interpreters employed for the Parliamentary sessions to freelance interpreters working for the Commission and Court of Justice;

2. Call upon the Delegation to consider with the Institutions how to prevent double taxation;

3. Deplore that 6 weeks before the current Convention expires, negotiations for its renewal have not yet started;

4. Consider that the call for expressions of interest was entirely without justification because the Convention is not part of a process of awarding contracts; for 30 years it has been recognised by all parties to the Convention as an element of social dialogue whereby a negotiating delegation is elected, its negotiating mandate adopted and the outcome of negotiation approved;

5. Reject the notion that associations which have not sought legitimacy from the assembly of freelance interpreters accredited by the institutions, be entitled to negotiate on their behalf;

6. Recall that the freelance interpreters to whom the new convention should apply, have already democratically elected their negotiating delegation, and that it alone is entitled to speak on their behalf and defend their interests;

7. Reaffirm their support for their negotiating delegation and reject attempts to dictate its composition;

8. Consider themselves currently unable to take up long term offers from the Commission, to the extent that the offers are binding on neither party and that the conditions of recruitment will not be known until the new Convention has been signed.

9. Instruct their Delegation to pursue consultations with staff colleagues, trade union and professional organisations, with a view to possible action.
