AIIC-EU NEGOTIATING DELEGATION REPORT
3 MARCH 1999

As part of the negotiating timetable, a meeting was held on Monday 1st March in Brussels between the AllC delegation and the European Institutions. At the meeting the delegation felt obliged to call to mind para 2 of the preamble to the Convention : « Emphasising the continuity of the agreements concluded between AllC and the Institutions since 1st January 1969, particularly the provisions covering social protection ». The Institutions then recognised the importance of the social achievement of the deduction at source by the employer of the pension and sickness insurance contributions and their direct transfer to the pension and insurance funds.

The Institutions however wish to maintain their proposal to create 3 categories of interpreters and for payment of a lump sum comprising fee, subsistence and travel allowances on the basis of 3 geographic zones ( see our last report). They made clear however that they do not propose taking away the acquired rights of those who already enjoy them. The proposals should be seen in the overall context of flexibility and administrative simplification.

The delegation repeated its firm commitment to the principles which underpin all past conventions and which constitute the only viable basis for discussion. The delegation emphasised the master-servant relationship ( employer-employee), and rejected any attempt to convert freelance interpreters into service providers. Furthermore, the delegation recalled the main prinicples of equality of treatment, quality and improvement of the acquis.

The next negotiating session will be held in Strasbourg on 08/03/99, and Brussels on 15/03/99. There will be an information meeting in Strasbourg on 10/03/99 and another sectoral meeting in Brussels on 17/03/99.

The technical working group on the consequences of the Court ruling of 16/07/98 is continuing its work, and should be in a position to present its conclusions after the next meeting on 16/03/99.

The delay in payments has been brought up with the Institutions. The Head of SClC has said that the problem has been solved for Brussels. There are problems with the computer interface in Luxembourg, but this should be resolved soon. At the sectoral meeting the professional delegations at the Commission and Parliament reported on the steps taken to deal with these problems. Please take matters up with them.

Dans le cadre du calendrier de négociation, une rencontre a eu lieu ce lundi 1er mars à Bruxelles, entre la délégation AllC et les représentants des Institutions européennes.
A cette occasion, la délégation a tenu, avant toute chose, à rappeler le paragraphe 2 du préambule de la Convention : « Soulignant la continuité des Accords conclus entre l"AllC et les Institutions depuis le 1er janvier 1969, notamment en ce qui concerne les dispositions en matière de protection sociale ». Les Institutions ont alors reconnu l'importance de l'acquis social représenté par le prélèvement à la source par l'employeur des cotisations PVD et assurance-maladie, et leur versement direct aux caisses de prévoyance.

Les Institutions souhaitent par contre maintenir leur proposition de création de 3 catégories d'interprètes et de forfaitarisation rémunération, frais de séjour et indemnités de voyage en fonction de trois couronnes ( voir topo précédent). Elles insistent pourtant sur le fait que ces propositions ne visent nullement à réduire les droits acquis de ceux qui les détiennent. Ces propositions doivent être vues dans un contexte général de flexibilité et de simplification administrative.

La délégation a réitéré son attachement profond aux principes qui ont régi les conventions jusqu'à présent, et qui constituent la seule base de discussion possible. Elle a insisté sur le lien de subordination ( employeur-employé) qui lie les interprètes aux Institutions, et a rejeté l'approche de la prestation de service. De plus, elle a rappelé les grands principes d'égalité de traitement, de qualité, et d'amélioration de l'acquis.

Les prochaines réunions de négociation auront lieu à Strasbourg le 08/03/99 et à Bruxelles le 15/03/99. Une réunion d'information aura lieu à Strasbourg le 10/03/99, et une nouvelle réunion sectorielle sera organisée à Bruxelles le 17/03/99.

Le groupe de travail chargé d'étudier les conséquences des arrêts du TPI du 16/07/98 poursuit ses travaux, et devrait pouvoir présenter des conclusions après la nouvelle réunion qui se tiendra le 16/03/99.

La question des retards de paiement a également été abordée. Pour Bruxelles, le chef de service du SClC a déclaré que le problème était réglé. Pour Luxembourg, il y a des problèmes d'interface informatique, qui devraient être résolus bientôt. A la sectorielle, les délégations professionnelles de la Commission et du Parlement ont présenté les démarches entreprises en vue de résoudre les problèmes rencontrés.
