D ELEGATION - EU COMMISSION SCIC sent a communication to several accredited freelance interpreters on 5th November, enquiring into their availability up until the end of July 1999. It said that as the AIIC-EU convention expires 31/12/98, both parties reserve the right to cancel contracts agreed if in the meantime new provisions have come into force. In answer to correspondance sent by the professional delegation at the Commission, SCIC stated that it would apply the working and pay conditions for freelances contained in the current convention until the entry into force of the new convention. SCIC also declared that if the new convention is agreed before the 31st July 1999, its terms and conditions would apply as of its entry into force; for this reason the administration has allowed for cancellation by either side, as set out above. The professional delegation, in its communications, has pointed out that under contract law the party which offers the contracts must disclose all contractual conditions to the other party. This SCIC has signally failed to do, as it is offering contracts for which it does not know the conditions itself. Moreover, the delegation questions if it would be in an interpreter's interest, under the SCIC scenario, to sign contracts up to 31/07/99, if a new convention were, for example, to enter into force on 1st March. As of that date the administration would be entitled to cancel the forward contracts which it is duty bound to honour. The delegation has therefore asked SCIC to remove the cancellation clause. In this connection it is interesting to note that neither the Parliament nor the Court of Justice - likewise parties to the convention - has introduced a clause of this nature.
